Walter Martinez, a 37-year-old El Salvadorian national, was sentenced to 42 months in federal prison on Tuesday for illegal re-entry into the United States. Martinez has previously served time in U.S. jail for assault as well as felony charges of sexual misconduct with a minor. The MS-13 gang member is sentenced for deportation upon release from federal custody.

"Walter Martinez is a known MS-13 gang member and convicted felon who was removed from the United States only to resurface and be arrested – and convicted, for sexual misconduct of with a minor," Field Office Director Robert Guadian, ICE’s Enforcement and Removal Operations (ERO) Chicago, said in a statement. "It is the job of the brave men and women of ERO to continue to take those who break the laws of this country off the streets and see that they are removed back to their home countries."

According to the most recent data from Federal Bureau of Prisons, roughly 19 percent of all federal inmates are illegal aliens. That is 33,410 illegal aliens in federal prisons alone. That figure excludes state data as well.

However, recent data from Texas state prisons show that between June 2011 and April 2018, more than 250,000 criminal aliens were sentenced to jail

via CIS:

Over 250,000 criminal aliens were booked in Texas local jails between June 2011 and April 2018. These individuals were charged with more than 663,000 offenses, including:

  • 1,351 homicide charges
  • 79,049 assault charges
  • 18,685 burglary charges
  • 79,900 drug charges
  • 815 kidnapping charges
  • 44,882 theft charges
  • 50,777 obstructing police charges
  • 4,292 robbery charges
  • 7,156 sexual assault charges
  • 9,938 weapons charges.

But, the federal govenrment promises to continue  track down illegal aliens who pose a threat to the country-at-large.

"The U.S. Attorney’s Office remains committed to prosecuting those individuals who illegally re-enter the country, especially those who have violent criminal histories, and are a risk to public safety," U.S. attorney Josh J. Minkler said regarding Martinez's sentencing.
