Another State Will Not Comply With Biden's Rewrite of Title IX

This week, Townhall covered how the Biden administration rewrote Title IX, the federal civil rights legislation that took effect in 1972 to prohibit sex discrimination in federally funded schools, in an effort to push the LGBTQ+ agenda on Americans.

Going forward, the basis of “sex” now encompasses the concept of “gender identity.” This means that if a man says he “identifies” as a woman, he is entitled to partake in women’s activities, use women’s spaces, and others have to use his preferred pronouns and chosen name.

Predictably, Biden’s rewrite of Title IX angered many Americans, as they pointed out that this is the left’s latest attempt to erase women.

One Republican governor, Ron DeSantis (FL), announced Thursday that his state will not comply with this rewrite.

“Florida rejects Joe Biden’s attempt to rewrite Title IX. We will not comply and we will fight back. We’re not going to let Joe Biden try to inject men into women’s activities. We’re not going to let Joe Biden undermine the rights of parents. And, we’re not going to let Joe Biden abuse his constitutional authority to try to impose these policies on us here in Florida. We stand with opportunities. We are not going to let Biden get away with it. We will not comply,” DeSantis said on X.

This week, top education officials in Oklahoma and Louisiana instructed their schools to ignore Biden’s rewrite of Title IX.

In the letter, Louisiana Superintendent of Education Cade Brumley said “these new Title IX rules could be in direct contradiction with Louisiana’s Fairness in Women’s Sports Act, a law that affirms school-sanctioned athletic participation must be divided by biological sex unless the configuration is co-ed in nature.”

Ryan Walters, the state superintendent of public instruction in Oklahoma, wrote to school officials that there are “some serious concerns with the legality of these rule changes, especially as it relates to its redefinition of ‘sex’ to include gender identity.”

“I believe these rules changes are illegal and unconstitutional. They violate the First Amendment, the Administrative Procedures Act, and longstanding civil rights protections for women and girls,” he continued, adding that Biden’s Title IX rewrite puts “women in danger.”
