Kash Patel Must Purge the FBI of Deep State Actors and Secure Justice for FBI Whistleblowers

As we watch the Left in the Senate slow-walk Kash Patel’s nomination for FBI director, it becomes abundantly clear – this FBI is still made in the likeness of James Comey and Christopher Wray. President Trump’s election didn’t change that fact.

Over the last several days, reports of FBI leaks related to Immigration and Customs Enforcement (ICE) raids have stirred significant concern. ICE thought it could call on the FBI to help rid the streets of dangerous illegal immigrants – perhaps not. The initial leak allegedly involved sensitive information about planned raids targeting the Venezuelan gang Tren de Aragua in Aurora, Colorado. As a result, the leak raised serious questions about the continued presence of Deep State actors planted in the FBI.

U.S. Attorney General Pam Bondi didn’t hold back when she told Fox News that those leaking intel about upcoming ICE raids would be prosecuted:

"[P]eople don’t understand that [it] jeopardizes the lives of our great men and women in law enforcement. And if you leaked it, we will find out who you are, and we will come after you. And it’s not going to stop our mission. It’s not going to stop the president’s mission to make America safe again. We were very clear with the lawsuit that we filed in Chicago that if you don’t follow the law, you will be prosecuted by the Department of Justice."

Bondi’s comments came on the heels of Department of Homeland Security Secretary Kristi Noem accusing the FBI of tipping off ICE deportation raids. “The FBI is so corrupt,” Noem wrote on X. “We will work with any and every agency to stop leaks and prosecute these crooked Deep State agents to the fullest extent of the law.”

Noem’s comments stemmed from the LA Times publishing an article last Friday that a “large-scale” ICE raid was headed to Los Angeles. This article – spurred by a leaked memo – angered Noem (and Bondi) because of multiple failed ICE raids.

Border Czar Tom Homan confirmed on Monday that “some of the information we’re receiving tends to lead toward the FBI” and vowed retribution for whoever is found responsible. Homan added, “I talked to the deputy attorney general all this weekend. They’ve opened up a criminal investigation, and they have promised that not only will this person lose their job and lose their pension, they will go to jail.”

Unfortunately, these leaks undermining Trump’s ICE raids are unsurprising. If you recall, in President Trump’s first term, leaks were the first sign that the Deep State was moving against the president. Despite having a conservative White House, we’re less than a month into the new administration, and the Deep State’s corruption remains deeply ingrained. It’s why the administration has preemptively acted to identify Deep State sabotage by firing partisan elements in the DOJ and FBI.

At the ACLJ, we actively expose the corruption of the Deep State. Former FBI Director Christopher Wray’s abuses are well documented, leaving the agency’s reputation in tatters. Though these abuses didn’t begin with him, the targeting of Americans, abuse of authority, and misinformation campaigns intensified under his leadership. Whistleblowers helped bring Wray’s “sins” to light.

After the Deep State FBI was exposed in April 2023 for putting undercover agents in churches to spy on Christians, Wray testified before the Senate Judiciary Committee that a field office had gone rogue. Of course, the truth came out that multiple field offices across America had undercover agents keeping tabs on what pastors were teaching their congregations.

If not for a brave FBI whistleblower, we may never have known that the FBI was weaponizing threat tags to target pro-lifers in the wake of the Dobbs decision. In the face of increasing violence against pro-life Americans and pro-life Pregnancy Resource Centers, Biden’s FBI targeted peaceful pro-lifers, all of which a whistleblower brought to light before Congress.

If that weren’t enough, the country learned that the FBI investigated parents who spoke out at school board meetings when a memo from then AG Merrick Garland led to a task force monitoring threats against school board officials – while giving the Left’s violence a pass. Though Garland assured Congress this task force wouldn’t target parents, a whistleblower revealed a conflicting Justice Department memo issued a day before Garland’s testimony. The memo, signed by top FBI officials, assigned the FBI’s criminal and counterterrorism divisions to issue a “threat tag” to categorize cases against parents as terrorists.

And, I could go on with even more examples.

Whistleblowers are why such abuses came to light. These brave individuals risked their careers to expose the truth. Their reward? Revoked security clearances, indefinite suspensions without pay, banned from seeking other employment – trapped in a cruel limbo, unable to provide for their families.

The ACLJ is honored to represent two of them: FBI Staff Operations Specialist Marcus Allen and FBI Special Agent Garret O’Boyle. We won on behalf of Agent Allen, but our fight for Agent O’Boyle is still ongoing.

Agent O’Boyle deserves a resolution to this nightmare, and we look forward to justice being secured after Patel is confirmed as FBI director, which appears to be moving forward after being passed out of the Senate Judiciary Committee on Thursday by a 12-10 vote. We also look forward to Patel restoring an agency that was once held in high esteem by all Americans. But it’s clear that there’s still yeoman’s work left to be done to expel the Deep State from the FBI.
