Welcome back to the "Stream of Kurtiousness!" I'm following a decision in Michigan's Supreme Court where a bunch of animal activists filed on behalf of seven chimpanzees to free them from a ranch that was holding them. Common law is a set of unwritten rules that form a general understanding of how the law should be applied. A principle of common law is that humans have rights and everything else does not. In Michigan, a liberal justice wrote in her dissent that we have a new understanding of what a conscious creature is and should consider that animals have the same rights as humans too. This is a goofy position, but it's also pretty scary. She's basically saying that law is abstract and that we should rewrite laws based on whatever is currently on trial. This judge has decided to take it upon herself to decide when statutes change. She didn't give the voters or elected leaders a chance to make that change; she took it upon himself! The Constitution is not a living document. Those who say that it is are telling their constituents a lie and are frauds! Don't let this become normalized.
